Child dies after being struck by tractor

For one young Chicago girl, there will be no summer vacation spent playing with friends or on trips to Lake Michigan. According to Chicago police, the 7-year-old died after being hit by a tractor when she attempted to cross a street with her mom. The spokeswoman for the Chicago Police Department stated that the fatality occurred shortly before 8 a.m., on the South Side in a West Englewood neighborhood.

Cook County's medical examiner were able to confirm the identity of the deceased child. Authorities said that she got hit by the trailer of the southbound tractor. She was pronounced dead on arriving at University of Chicago Comer Children's Hospital.

According to the spokesperson for the mayor of Chicago, the tractor was being driven by a Streets and Sanitation Department contract employee. That driver was cited in the accident.

The accident opens up potential liabilities for the city of Chicago, the driver and the insurance company that wrote the policy for the department. Those who face similar situations, where a business entity or city agency bears liability for their damages following an accident with injuries, may wish to seek legal guidance and advice before accepting any final settlement with an insurance company.

Even when an injured party wants to attempt to negotiate his or her own settlement with the at-fault party or parties, having an attorney review the proposed settlement offer is a good idea. He or she can advise the injured claimant as to whether the settlement offer is a good one or has been low-balled. Should negotiations then turn sour, the attorney can file a petition for damages and avoid the case proscribing.
