16 in restaurant injured after car hits building after wreck

It was not something the diners were expecting as they lingered over their Saturday night dinner at a restaurant on Chicago's Northwest side in the Logan Square neighborhood.

Following the collision of two vehicles in the intersection of Kimball and Fullerton, one car slammed into the front of the eatery located at 3400 W. Fullerton Ave., Jibaritos y Mas. The patrons were sprayed with shattered glass; reports indicate 16 were injured.

A restaurant employee told media staff that four members of a family were at the register settling their bill at the time of the wreck. A young girl was injured by the glass.

Nine of the injured victims were taken to local hospitals after the crash -- three to Norwegian American Hospital, two adults in serious condition to Northwestern Memorial Hospital, two more in good condition to Illinois Masonic Medical Center and two children in fair condition to Lurie Children's Hospital, fire officials reported.

Nine individuals at the collision scene declined treatment.

One of the drivers involved in the accident was given citations for failing to stop at the red light, no driver's license, no insurance and striking fixed property police sources said.

In a case such as this one, should all or some of the injured victims decide to pursue civil litigation to recover their medical expenses and be compensated for pain and suffering, among other things, there may be multiple defendants who can be named in a suit.

For instance, hypothetically both drivers and their insurance companies are potential defendants. It may also be possible in similar situations to name the restaurant for not having a more secure facade or the city if the light had somehow malfunctioned.
